How to make your pool compliant with Quebec's new regulations

Safety around a residential swimming pool goes beyond mere supervision. A compliant enclosure , a secure gate, and thoughtful design significantly reduce the risk of accidental access, especially for young children.
In Quebec, the rules apply to outdoor residential pools that can hold 60 cm of water or more , whether they are in-ground, above-ground, semi-in-ground or portable.
Here are the main things to check.
A secure enclosure around the pool
When a speaker is required, it must, in particular:
measure at least 1.2 meters (4 feet) in height.
prevent the passage of a spherical object larger than 10 cm (4 inches).
present a maximum clearance of 10 cm below the fence.
to be designed in such a way as to be difficult to climb.
to be kept in good condition.
A hedge, even a dense or very tall one, cannot replace a proper fence.
Caution: Chain link fences are subject to specific requirements. The mesh size must generally be 30 mm or less , unless slats are installed to reduce the opening. It is therefore important to check the chosen model before installation.
A self-closing gate
Any door providing access to the pool area must meet the same specifications as the fence.
The portal must also:
close automatically.
lock automatically.
remain closed when not in use.
have a latch installed on the inside, in the upper part of the gate, or on the outside at a minimum height of 1.5 meters .
A gate left open, even temporarily, negates the effectiveness of the entire enclosure.
Keep equipment away from the fence
The filter, heat pump and other equipment used for the operation of the pool must not be able to be used as a step to cross the fence or the wall of the pool.
When placed outside the enclosure, they should normally be installed more than one meter away from it or the wall of the pool.
They can be placed closer together when they are:
inside the enclosure.
in a shed.
under a structure at least 1.2 meters high , difficult to climb and preventing access to the pool.
As a precaution, also avoid leaving furniture, containers, plants, a barbecue or any other object that could facilitate climbing directly against the fence.
Are above-ground pools exempt?
Not necessarily.
An above-ground swimming pool with a wall measuring less than 1.2 meters must be surrounded by an enclosure.
For a removable swimming pool, this limit is 1.4 meters .
When the wall height allows it to not directly surround the pool, access to it must still be secured, for example by means of:
of a removable ladder equipped with a safety door.
of a platform protected by an enclosure.
from a terrace whose access to the swimming pool is secured by a fence.
Access devices must close and lock automatically.
A new deadline: September 30, 2027
Owners of a swimming pool installed before November 1, 2010 now have until September 30, 2027 to bring their installations into compliance.
Swimming pools installed from November 1, 2010 onwards are already subject to the regulations and must comply with the applicable standards.
Check your municipality's requirements
Municipalities are responsible for enforcing regulations, issuing permits, and conducting inspections.
Additional municipal requirements may therefore be added to provincial standards.
Before installing or modifying a pool, fence, gate, deck or platform, contact your municipality to confirm applicable rules and obtain the necessary permit.
